A NEW UK PLASTIC PACKAGING TAX

Aligned with the global focus on environmental, social and governance (ESG) issues, and with the aim of stimulating the market in recycled plastic, the plastic packaging tax came into force in the UK on 1 April 2022.

The tax presents the estimated 20,000 businesses due to be affected, and their advisers, with the unique challenges associated with the implementation and operation of a new tax.

THE TREATMENT OF FOODSTUFFS IN THE EXCISE DUTY ON ETHYL ALCOHOL

The treatment of food products regarding the excise duty on ethyl alcohol has some peculiarities to other industrial sectors in which alcohol is used. As a general rule, the goal of the levy is to tax the consumption of alcohol contained in alcoholic beverages and, for this reason, everything that is not linked to such use should benefit from an exemption or a refund. However, this is not exactly the case on the UE legal context.

CUSTOMS LABORATORIES IN THE EUROPEAN EXCISE DUTY LANDSCAPE

The European customs laboratories, act as supporting mechanism for local customs authorities. Especially in the case and works related to excise duty products, the full TARIC classification becomes of essential importance, considering that the national per member state tariffs (co-efficients) of excise duties and VAT appear in the last four numbers of the 22 figured TARIC code.

ENVIRONMENTAL TAX IN DENMARK: EXCISE DUTIES ON PACKAGING WHEN SELLING ALCOHOL IN DENMARK

Foreign companies selling alcoholic beverages to Danish customers may not be aware of the national packaging duty that must be declared and paid alongside the excise duties for spirits, wines, and beers.

The packaging legislation covers excise duties and the Danish bottle deposit scheme.

ITALY: EMERGENCY ENERGY COSTS AND EXTENSION OF THE REDUCTION IN EXCISE DUTIES: EXCISE DUTY RATES REDUCTION

Due to the Ukraine emergency and the ensuing repercussions on the final cost of energy products, the Italian Government has extended the temporary reduction of excise duty rates on energy products widely used as motor fuels.

FRANCE - "TARIFF SHIELD" IN THE EVENT OF ELECTRICITY PRICES RISE

In order to limit the effects of electricity prices rise on households, businesses and public bodies, the French legislator has provided for a mechanism to reduce the excise duty on electricity. This is an exceptional measure implementing the tariff shield provided for in Article 29 of the 2022 Finance Act.

RECOVERING UK EXCISE DUTY PAID ON GOODS DAMAGED OR RETURNED

Occasionally excisable product imported for sale to the UK market arrives damaged or the UK customer may refuse delivery. If goods have been imported and the excise duty paid, the importer potentially suffers financial loss unless the duty is recoverable.
